Seller/Buyer agreement/ Genetic health guarantee.

The buyer is to pay a non-refundable deposit on the pup in the amount of $___________ Date ____________
Should the buyer decide not to purchase the pup, the deposit will be forfeited or
transfered to another litter.

The following guarantee from the seller (a.k.a. Dynasty Yorkies) is 72 hours no death. With the buyer understanding that after this date all guarantees both verbal and implied shall be null and void. Dynasty Yorkies guarantees the above canine against death from infectious diseases for 72 hours from date of purchase (date buyer takes possession of the canine) with veterinarian verification (i.e. test results, necropsy report, etc.). When death occurs a necropsy shall be required to verify the death. Accidents (of any type)will not be covered under this quarantee. All paperwork and test results must be forwarded to Dynasty Yorkies or designee. After confirmation from Dynasty Yorkies veterinarian, as to the cause of death, a full refund will be made to the buyer minus the shipping price. Dynasty Yorkies MUST be notified within 72 hours of death.
Seller agrees to replace the dog with another dog of equal value from the next available litter if it should have a major genetic fault (eyes/heart/ hips/patellas/liver shunts/cryptorchidism. .. etc.) (shipping is the buyers responsibility). Any genetic fault that will cause the dog not to lead a healthy life. Genetic health guarantee is for 12 months from birth date (Genetic guarantee will end at the puppy's first birthday). With verification from the buyers veterinarian (i.e. x-rays, reports, etc.) and verification from Dynasty Yorkies veterinarian shall be required. Dynasty Yorkies MUST be notified within 12 months from date of purchase with any complaints. Genetic faults that are NOT included in the 12 month health guarantee are bites/umbilical hernia/allergies as these faults will not render the dogs life.
Under no circumstance will the buyer ever be allowed to keep the above canine and receive money or a replacement canine. Prior to any refund or canine replacement, the above canine and all paperwork shall be returned to Dynasty Yorkies, except in case of death. The buyer must have the canine examined by a certified veterinarian within 72 hours of receiving and contact seller with results of examination. If buyer does not comply, all above guarantees are null and void. Dynasty Yorkies will not, under any circumstances, be held responsible for any veterinarian fees for the initial care, extended care, treatment or test of the above canine after purchase date. The buyer shall be responsible for any and all cost incurred.
Dynasty Yorkies is not responsible for the size, conformation or disposition of this canine after date of purchase. The above canine is sold for pet purposes only. Dynasty Yorkies does not guarantee registration papers. If there were to be a legal dispute due to buyer and Dynasty Yorkies not agreeing , absolutely all legal issues will be resolved within Jefferson County, in the state of NY per this guarantee and is subject to NY laws only. Out of state laws are not valid per this guarantee. All attorney fees and court cost will be the buyer's responsibility. Dynasty Yorkies does not guarantee the breeding ability of this canine or show quality, this canine is purchased as pet quality only.
The Following are any exclusions to this guarantee:
The buyer does knowingly purchase this puppy with the following conditions, faults or characteristics. The seller will not be held responsible for any of the following items now or at anytime in the future:
Buyer will notify seller at least on every 1 year basis as to the dogs condition and provide a current photo of the dog. Buyer will also provide a current health certificate from a licensed veterinarian if the seller requests it. Buyer will notify in writing a new address should they decide to relocate. Buyer agrees to socialize the dog, keep it in healthy condition , feed it a quality food and keep fresh water available 24 hours 7 days a week.
If at any time the buyer decides that he or she can no longer keep the dog they must first offer it back to the breeder (Dynasty Yorkies) at 25% of the original purchase price. If the breeder/seller does not buy the dog back it can be sold to another party once permission is given in writing by the breeder. The new owners must sign and abide by this original agreement. The breeder will provide a new contract and assist in the sale of the dog to ensure the dog gets a proper home.
If there is evidence of the dog being abused or neglected the seller/breeder will reposes the dog with no financial reimbursement to the buyer or new owner. The buyer also agrees to sign over all registration certificates to the seller/breeder immediately.
The undersigned Buyer and Seller acknowledge that this is a legal and binding contract
and have received a assigned copy.
